The Kagan Court Abandons the Rule of Law

Washington—The Supreme Court today decided the landmark abortion case June Medical Services LLC v. Russo, overturning a Louisiana law placing common-sense health guidelines on abortion providers and requiring doctors performing abortions to have admitting privileges at local hospitals. Heritage Action for America released a statement from Executive Director Jessica Anderson in response to the decision:

Today, the Supreme Court betrayed the rule of law and the dignity of the bench. They ruled against women’s health, the right to self-government of the state of Louisiana, and life itself.

Chief Justice Roberts, who dissented in a similar case in 2016, has reversed course to cast the deciding vote to overrule the Louisiana legislature’s decision to protect women’s health. This is the latest in a series of judicial power grabs from the Chief Justice and the liberal wing of the court, who have consistently ruled on the basis of progressive politics instead of respecting the law, the will of voters, or the basic dignity of life. Justice Roberts, a so-called “conservative,” is clearly no longer running things — it’s now the Kagan Court.

This is a dark moment for the Court. Our ideals are under attack from every corner, including the highest court in the land. Thankfully, nine judges don’t have ultimate power. Activists and legislators in every state can and should fight for life and for our freedom — or else we’ll lose both.
