Court Ruling on Obamacare Gives Congress Another Chance to Get Health Care Right

Washington—Today, the U.S. District Court for the Northern District of Texas ruled Obamacare unconstitutional. The Court ruled that the law cannot stand in the aftermath of Congress rolling back a mandate requiring everyone to buy government health insurance or pay a tax. Most likely, this verdict will get appealed to the Fifth Circuit and then to the U.S. Supreme Court where its ultimate fate will be decided.

Regardless of this court case’s future fate, Obamacare has driven up costs and reduced choices. This ruling gives Congress yet another opportunity to act. The Health Care Choices Proposal offered by a broad coalition of free market leaders, including The Heritage Foundation, would give states flexibility to begin to heal their broken private markets, lower health care costs and improve coverage choices for all Americans.

Americans should not fall for the tired myth from Democrats that only Obamacare protects pre-existing conditions. If Congress returns control of health care back to the states, it will give more Americans, even those with pre-existing conditions, greater access to affordable health care.
