WASHINGTON—Today, the Senate approved H.J.Res. 38, a House-passed resolution disapproving of the so-called "stream buffer" rule submitted in the waning days of the Obama Administration. Once it is signed into law by President Trump, the disapproval resolution will ensure that the final Stream Protection Rule (SPR) has no force or effect and that the Department of the Interior's Office of Surface Mining (OSM) cannot issue a rule that is substantially the same without subsequent authorization from Congress. Heritage Action released the following statement from Chief Executive Officer Michael A. Needham:
"Congress took a positive step today by using the Congressional Review Act to provide a check on excessive regulations pushed forward by overzealous bureaucrats. As the first successful use of the CRA in 16 years, it is a perfect example on how to use the legislative process to undo the job-destroying regulations put in place by the Obama Administration. Lawmakers should continue this approach to dismantle the big government policies of the last eight years."
