Collins Gun Bill Erodes Constitutional Rights at the Discretion of the Government

Washington -- Today, Sen. Susan Collins (R-ME) is set to unveil a bill that would empower the attorney general to deny gun sales to those on the No Fly List or Selectee List. According to The Heritage Foundation's senior legal fellow Hans von Spakovsky, the proposal is "potentially unconstitutional since it would take away a constitutional right ... at the discretion of a government official in a secret, non-transparent process that has no adequate due process protections." Heritage Action released the following statement from chief executive officer Michael A. Needham:

"Due process rights are not an impediment to our way of life--they are vital. Rather than presuming guilt and denying Americans their second amendment rights, lawmakers should debate and vote on counterterrorism measures that would actually help keep us safe. Americans deserve real leadership on the issue of Islamist terrorism, not made for TV sound bites intended to erode our constitutional rights."
