"NO" on Cloture on Motion to Proceed on America Invents Act (H.R. 1249)

This week, the Senate will vote whether to invoke cloture on the Motion to Proceed to H.R. 1249, the House-passed patent reform bill. Although the House modified the legislation to address our prior concern with respect to fees raised by the PTO, the associated deal on CJS remains constitutionally flawed because it purports to give the appropriations power of Congress to two committees rather than the whole Congress.

Because this deal is wrapped up in passage of H.R. 1249, Heritage Action remains opposed to H.R. 1249 and will include the vote as a key vote in our scorecard.
