The legislation would preempt the regulation of greenhouse gases under federal law for the purposes of combating global warming.

The importance of such preemption cannot be understated. According to a Heritage Foundation study, regulations similar to those being implemented by the Environmental Protection Agency (EPA) would cause annual jobs losses to exceed 800,000 in several years and some industries would see job losses that exceed 50 percent.
The legislation would reassert Congress's role in developing our nation's energy and environmental policies. No federal agency would be able to regulate greenhouse gases for the purposes of combating global warming unless specifically authorized by Congress. It would stop the EPA's current regulatory agenda in its tracks and preclude additional regulation under the Clean Water Act, Endangered Species Act and the National Environmental Policy Act.
President Obama's stated concern of over-regulating America's dynamic economy is well founded. Efforts being undertaken by the EPA and other agencies will stunt our economic growth and stifle the sort of innovation necessary to "win the future."
