Protecting Religious Freedom in D.C.

Status: The D.C. City Council is working to undermine religious liberties in its jurisdiction.  Two bills—both passed by the D.C. Mayor, Muriel Bowser—will saddle religious organizations and employers with a choice between upholding their beliefs as they perform their organizational missions or complying with a coercive government regulation that forces them to violate their beliefs and missions.

  • The Reproductive Health Non-Discrimination Act: The bill would force pro-life employers in the District to cover elective, surgical abortions in their health plans. The Act could also force religious and pro-life employers opposed to abortion to hire openly pro-choice employees.  For private organizations to be required to hire someone with a viewpoint diametrically opposed to their core principles is a serious infringement on the right of free association.
  • The Human Rights Amendment Act: Also passed before Christmas, this bill eliminates a 1989 provision passed by Congress that protects religious educational organizations from being coerced into “promoting, encouraging, or condoning any homosexual act, lifestyle orientation, or belief.”  Under the Human Rights Amendment Act, a religious school could be forced to host a gay pride day, “coming out” day, or support a student group dedicated to furthering LGBT activities.  These infringements undermine a major reason why parents choose private schools over public schools: the fact that these institutions are often more harmonious with parents’ deeply held religious values.  The Amendment could also require these organizations to hire employees whose personal values conflict with longstanding religious doctrine.

Congress and the D.C. Government: Article I, Section 8 of the Constitution gives Congress the power to “exercise exclusive Legislation in all cases whatsoever” over the District. Under that law, which remains in effect today, the D.C. City Council acts as a legislature for the district unless it is explicitly overruled by Congress.

Congressional Overrule: When D.C. passes a law, the City Council transmits the law to the Speaker of the House and the President of the Senate.  Once the transfer is complete, a review period of roughly thirty days begins. If, within the review period, both houses of Congress pass a joint resolution disapproving the law, and the President signs the joint resolution, the D.C. law is overturned.  If he does not, the law goes into effect.

Call to Action: Religious freedom is a core American value.  Activists are encouraged to urge their representatives to use their authority over Washington, D.C.’s government to stop these intrusive and flawed laws from going into effect.

  2. Just curious: what is the connection between Heritage Action and the Heritage Foundation? I see they both share the same DC street address and that the foundation is the “sister site,” but what does that mean?

  4. The First Amendment guarantees that the government can not establish a state religion. Instead of putting out the same old defensive arguments, start pointing out that the government (in this case a city) is attempting to force everyone to follow a religion established by the “state”.

        There are “religious freedom” arguments made by pro-choice people who do not want THEIR religious freedom curtailed; they do not want anyone forcing any particular set of religious beliefs and behaviors on them by telling them that they can’t have an abortion. Heck, they go one step farther and demand that people who have differing beliefs PAY for their abortions.

        So, you tell me. If a person who does not believe in abortions and does not want to pay for someone else to have one is forced by the government to modify his/her behavior then is this not the government choosing one religious belief system over all others (aka establishing a state religion)?

Forcing someone to violate their conscience or religious belief, to provide for abortion (the ripping apart of a baby in the womb, see Youtube video), or affirming, or promoting homosexuality (previously a crime, & behavioral choice), destroys the First Amendment of the U.S. Constitution. Freedom of Speech, Freedom of the Press, and Religious Freedom (basically Freedom of Thought). If we don’t fight these laws, soon we will only believe what the Marxist Left says we can.

    • Col C, we can never stop abortions and if you have ever seen a woman almost bleed to death from a back alley abortion, it is not a pretty sight. doctors and hospital could not help because of the laws of the state and losing their lic. Near her end they did pick her and took her to the ER which saved her life. Which the also meant if a woman were to naturally abort in the doctor office, he or she could not help. Yet they could stand there and watch her die. I do not think that the government should pay for abortion except in the case of rape and that should be done immediately.         In the case of rape, why should the baby receive capital punishment for the crime of her father? And why should a woman submit to rape with surgical instruments to tear that baby apart? It is also an insult to the mother, because that’s HER baby, too, and our instinct is to protect our own children. What makes you think abortion is ever good for a rape victim? It makes me furious people use rape victims to push their abortion agenda!

The true American loves America, not Cuba, Iran, Isis, Kenya, Pakistan, North Korea, or other countries diametrically opposed to everything we are and stand for. He zealously supports our authority: authority to exist as an independent country (as defined in the Declaration of Independence) and authority to act (as defined in the Constitution). The authority to exist comes from the Laws of Nature and of Nature’s God (i.e., the Judeo-Christian God). Authority to act comes from our Creator’s endowment of unalienable rights such as life, liberty, and the pursuit of happiness through the consent of the governed. Isn’t it abundantly clear that atheism, abortion, coercion, and political favoritism are all unconstitutional?

He did not say that all would, neither did he say that it didn’t matter, in the end he was going to save everyone anyways, regardless of the condition of your heart. As a true follower of Christ, there comes a time when one has to stand up for what he believes. It does include sometimes, being tolerant & turning the other cheek, but it does not mean we are suppose to compromise our core beliefs as a Christian. Sometimes we have to stand up for what we believe, or we will fall for anything.

        • You obviously haven’t read the Bible. Jesus was kind to all, but had zero tolerance for sin. The best example of this was the woman taken in adultery and brought before Him. He did not deny that she had committed a grievous sin. To the vengeful and hypocritical Pharisees, He issued the challenge that if they wanted to condemn her, that the sinless among them should do so. One should take note of His parting words to her, however: “Go, and sin no more.” He was patient and forgiving of the penitent, but did not excuse the sin. He treated the woman with respect, but expressed zero tolerance for her acts even while mercifully withholding His condemnation.

  22. Sir, I am not pushing abortions and the back alley abortion are still out there. It only takes a wire clothes hanger to kill a woman and the fetus. You cannot stop abortions. They happened daily when they were against the laws an a doctor or hospital would rather see the women die rather help and lose their lic.
    Why should a raped woman or one of incest have to burden the responsibly of raising the unborn child which could be eliminated before it is in a fact a child. How many unwanted children are in the US and the world? How many bad foster homes are they in? More women die each year giving birth than they die from legal abortions.
    Many times a woman or girl that has been rapped or giving birth by incest is looked down on and in many cases ends up on the street scorned and broke.

It is documented, and suggesting that we do away with laws against murder, because people are just going to murder people anyway, does not make any sense. If a person isn’t held accountable for killing another person, there would be a whole lot more murders of those outside the womb.   29. It seems to me that these potential DC laws are in direct contradiction to the laws that guarantee freedom of religion, and in particular, the Restoring Religious Freedom Act. As such, Congress should strike them down.

    I understand that opposing Christianity is a fad right now, but DC may have failed to think beyond Christians. Thus, have to wonder how this would apply to any Muslims, who are far more conservative than most Christians. I have a feeling that any Muslim who objected to this policy would be exempted. If I’m correct in my assumption, they had better think twice about enacting these laws. Can you imagine the reaction to a law that exempts one religion, but not another?

The First Amendment to The Constitution of The United States states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peasably to assemble, and to petition the Government for a redress of grievances.”

In Huston Texas the Mayor is trying to sepia the Christan Church pastors to have them send their sermons to the mayors office so she can scrutinize them for any derogatory comments said about lesbians, gay, bisexuals, or transsexual (LGBT) people or groups. That is a direct violation of the First Amendment. The people of the city have drawn up a partition to have the law put to a vote. The City of Huston has a city government origination that runs the elections and counts votes and partitions. And the lady that has that job said there where 19,000 good and verifiable signatures on the partition. 2000 more than needed to pass for a referendum. But the mayor and the City Attorney went in and disqualified some of the signatures and said the partition was no good. The case is in court and being tried.
      2. A wedding photo business in New Mexico was forced to take pictures of a gay wedding against the free will of the photographer. Or pay the gay couple an enormousness fine.
      3. A baker in Colorado lost his business because a gay couple wanted him to bake a cake for their wedding. He said no do to Regulus reasons. The courts ruled against him. He had to colsed his business and pay an enormousness fine.
      4. a baker is Washington state aslso had a simuler case brought against him. He lost and forced to close his business and pay a enormousness fine.
      5. A couple in New York state had a farm with a very butyfull view where they rented out for weddings. A gay couple wanted their held inside the couples home. The couple said no due to religious reasons. They where sued by the gay couple. The farm owners lost the suit their farm and have to pay an enormousness fine.
      I can go on for an hour with cases like this. Do you get the point?

      • I totally get the point. What is happening in HoustonTexas is totally a violation of the first amendment. If it is actually true. Here ( ) is a list of the several hunderd churches in Houston. If each church provided a transcript of its (to play it safe i will say one hour long) sermon. It would take a mayors office more than a week to just read through them all. Sounds suspicious. In terms of voting on laws the majority is not always right. For example, if a town of 20,000 had a native american population of 25 and the town held a vote and the majority decided that the native population should be flogged every day at sunset for the entertainment of the town that would not be a righteous law. However I believe what is said inside a church should be held as sacred. Outside of thier holy ground, however, if the promote hate and violence and discrimination they should be held accountable for harm done. Businesses in this country should not be surprised to find themselves subject to local laws. If you are making money from the public, then you have to follow the laws governing a public business. These are not hidden laws. Any area where there is protection for certain groups the laws are made perfectly clear. You can choose to break them, but as in any other case of breaking a law there are cosequences if you are caught. I might choose to stab my neighbor to death and claim that I thought that law was for other people, but I would know damned well that I was subject to it. Ignorance of the law is no excuse.
        As for cases where someone feels discriminated against where there is no protection and feels the lack of said protection is unfare, then it is their right to contest that in the courts. I don’t believe the plaintiffs should be punished for actions that have not broken the law, but it is how we pass new protection in our system of litigation and what we have chosen as a society as the correct and civilized way to proceed. When people try to hide hate and fear behind religion, whatever religion or belief, and use it as a protection to harm others, it is an abuse of freedom and needs to be exposed. I might say I don’t like Catholics, that is my right. However when I choose to open a hot dog stand on the corner of a street in my town I don’t get the right to question customers on their beliefs. I don’t get to put up a “NO CATHOLICS” sign. I know they are protected by the laws and that if I am going to sell hot dogs to anyone, I don’t get the choice under the law to discriminate. That is why the law is there. People know when they are doing something that is unfair. Those business owners were not saying “Oh, I’m sure this won’t affect you in any way and you will walk out of here just as happy if I say I don’t serve YOUR KIND.” They knew they were being hurtful. They were running a business not a church. We have laws for a reason.

        • Sorry you don’t get it. In all the cases I mentioned, the business owners did try to direct the plaintiffs to a business that would take their money and be happy to do just that. The aggressors where not the church goers, but the gays that would not allow the businesses to function as they desired. The laws where not broken in any way but to not do a task against their Regulus and moral conviction.
          The case in Colorado the plaintiffs where from Connecticut, not Colorado. They wanted there cake sent to Connecticut.           • A grocery store does not have the right to tell a black person that, yes they do sell Campbell’s soup but just not to a black person, but that there is a store across town that do serve “their kind.” If you own a BUSINESS you have to follow the laws put on business owners. If I drive a car I have to stop at a stop sign or red light rather or not there is other traffic. I know this. Discrimination is wrong. People want equal treatment. If you or I were to make a reservation at a motel in another city, travel there, only to have a Hindi owner say ” Oh, wait. You look like a Christian. You cannot stay in my motel if you believe in Jesus. There is a pay phone outside call another motel. Your reservation is cancelled.” We would be mighty damned upset. No difference except that there is a good percentage of the gay community that are Christian. So by refusing service to a gay man, you are not refusing service because of his religion, but because of who he loves.

Like the law in Leviticus chapter 18 verse 22 that states “You must not lie down with a man (male) the same as you lie down with a woman. It is a detestable thing”.

It always fascinates me that some people who call themselves Christianm put more emphasis on old testament laws than the words of Christ. Then the try to be selective and tell me which laws God made made more important when they have no scriptural backing to prove. That is not how I was raised as a Christian. I was raised with “Judge not” and “Love one another” as fundamentals of my faith. I trust god to know what people deserve in the afterlife, and unless there is a viable and logical threat, I need not worry about punishing anyone. I was raised to trust God and Christianity, not to fear them. Why would I follow someone I fear? I believe we were given free will. I don’t get to choose for anyone else, nor do I allow anyone to make my choices. God trusted me with them and I trust God. Christ did not spend his time shunning the sick and the poor and the “unworthy.” Why should I?

Try awakening your spirit man to a real understanding of Jer. 1:5.     • Good grief. Of course they affect the freedom of others. Faith guides one’s every moment of one’s life. It doesn’t have a menu where one says I believe x but only when I am inside my home. One’s faith is a lifestyle….the Ten Commandments had no italicized text at the top saying these rules only apply if you are alone, in your home or inside your church. And that’s the problem. You want to express your thoughts and beliefs but you do not want anyone with religious belief to express theirs. That’s the issue. Already, Catholic charities have had to close their doors — organizations that placed the most children in foster care in the nation and have more experience that any other group. They had to choose between their Catholic faith and the US law. They chose God. Now people are forced to use their artistic or expressive skills to communicate the messages of Hunky Jesus contests — to do otherwise is to discriminate.

      America is not a place where freedom is for everyone. Now if you are a follower of Jesus and believe his words about marriage, you are discriminated against.

  32. Separation of church and state is a TWO-WAY STREET as well. This simply means that religion can’t dictate government policy, but also that government can’t dictate to churches what they can or cannot teach/believe. Why is that last part so hard to understand?
