Heritage Action supports the SAVE America Act (H.R. 7296 / House Amendment to S.1383) sponsored by Congressman Chip Roy (TX-21), to strengthen the integrity of American elections by requiring proof of citizenship and photo identification to vote in federal elections. This vote will be included as a Key Vote on our Legislative Scorecard.

The SAVE America Act would require both legal documentary proof of citizenship in order to register to vote and for individuals to present an eligible photo identification document to cast their vote. The combination of strengthened citizenship requirements at the point of registration and voter photo ID at the polling place works hand in hand to help secure elections.

Under current law, there is no uniform requirement among the states to provide proof of U.S. citizenship when registering to vote. Though it is illegal for non-citizens to register to vote, potential voters do not have to prove their citizenship when registering. This means the only mechanism for enforcement is retroactive.

In many cases, voter registration forms include a citizenship question, but there is no requirement to verify the applicant’s citizenship claim. In the lead-up to the 2024 election, there were several instances of non-citizens successfully registering to vote. The SAVE America Act would clarify the National Voter Registration Act, placing a requirement on states to obtain proof of citizenship and establish a process to purge any non-citizens from their voter rolls. It also enables integration of existing databases at the Department of Homeland Security and Social Security Administration to assist states removing ineligible individuals from their voter rolls.

Many states produce state identification cards and driver’s licenses for illegal aliens, and so it is more critical than ever to ensure that non-citizens are not exploiting lax driver license laws to vote in American elections.

Further, the voter photo ID requirement then ensures that an individual who completes a ballot is, in fact, the individual who is supposed to be casting it. This measure helps to deter ballot theft.

This is a popular and commonsense safeguard to reduce fraud in elections. A Pew Research Poll from August 2025 found 83% of American adults support requiring all voters to show government-issued photo identification to vote, with a partisan breakdown of 95% Republicans in favor and 71% of Democrats supporting. Americans understand that showing a photo ID is a simple way to confirm that someone is who he or she says they are, whether that’s boarding an airplane, buying a pack of beer, or checking in at a hotel.

The right to vote is one of the most sacred privileges of American citizenship. The integrity of our elections is central to public trust in the government and faith in the future of the Republic. The SAVE America Act closes existing loopholes that undermine election integrity laws and enable alien voting in federal elections while curbing voter fraud.
